Acceptance of Terms
Prior to signing up, downloading, or utilizing any products from WordPress Premium Themes & Plugins for your own purposes, it is imperative that you carefully read, comprehend, and agree to all the terms outlined herein. By using WordPress Premium Themes & Plugins or any other products, we (WordPress Premium Themes & Plugins) presume that you have accepted the terms of use provided below. We reserve the right to alter and amend these terms and conditions at any time without prior notice.
Product License
The WordPress plugins/extensions/themes, WooCommerce plugins/extensions & snippets, Joomla templates distributed via WordPress Premium Themes & Plugins are licensed under the General Public License (GNU). While all WordPress code of these products is licensed under the GPL, certain content such as images and Cascading Style Sheets (“CSS”) files may be subject to proprietary terms. It is advised to review the licensing terms accompanying any purchases to ascertain the applicable terms.
Product Delivery
All free downloadable products are directly available for download, while paid downloadable products can be accessed either through membership or as single products. Paid products become accessible for download upon successful payment verification. Payments are processed through PayPal, Master Card, Visa, American Express, and all major credit cards. Prior to purchasing any membership plan, you must agree to their respective terms and conditions.
Membership information will be dispatched to the provided email address upon payment. While our system typically generates accounts post-payment, certain circumstances may necessitate manual review and processing of download information. Consequently, delays may range from 1 hour to 24 hours, depending on the situation and extent of investigation required following a fraud alert.
Our system may retain all downloads made by users with premium membership.
Refund Policy
As digital media (software) can be downloaded instantly post-purchase, there exists no “trial” or “grace period.” Consequently, all sales are considered final once the software is purchased, precluding the possibility of refunds.
Product Support
Provider products and designs are offered “as is,” without any implied warranty concerning their performance or compatibility with all third-party components and plugins. While no technical support is provided via email or phone, we can assist with the installation of Themes or Plugins (Free/Paid).
Third-Party Support
Support for third-party products provided is the responsibility of their respective authors, not Provider. It is advisable to review the support terms offered by the product’s author before making a purchase from the third party.
Provider’s support is limited to billing and/or technical inquiries pertaining to the WordPress Premium Themes & Plugins website.
Product Updates
Upon sign-up, you will be charged on a recurring basis until you opt to cancel, which can be done at any time. Cancellation of your subscription will discontinue updates for any installed plugin/theme from Provider, unless the subscription is renewed. Each individual purchase (single product purchase) includes lifetime updates.
Customer Accounts
Customers are required to create an account when purchasing any products or membership. They are accountable for maintaining the confidentiality of their password and are prohibited from sharing and/or distributing their account login details. Customers are solely responsible for all activities conducted under their account and agree to promptly notify Provider of any unauthorized account usage or security breaches. Provider disclaims liability for any loss or damage arising from customer non-compliance with these terms. Users must be at least 13 years of age or older to sign up for an account.
Account Termination and Suspension
Provider reserves the right to suspend and/or terminate any user account without prior notice, at its sole discretion. No refunds will be issued to customers whose accounts are terminated. Reasons for termination may include, but are not limited to:
- Abusive behavior and/or excessive negativity towards Provider staff or other customers.
- Repeated defamation, malicious, or false statements including slander against Provider.
- Promotion of competitor products, contribution to software piracy, hacking, spamming, or other illegal activities.
- Suspected compromise, sharing, or other security-related concerns regarding the account.
- Redistribution or sale of products (WordPress Theme or Plugin) downloaded from WordPress Premium Themes & Plugins.
- Breach of Provider’s fair use policy.
Fair Use Policy
Provider enforces a fair use policy, permitting unlimited downloads with any chosen membership plan. Attempts to download an excessive volume of items at once or circumvent the policy may result in account suspension and/or termination.
- Leeching: Any attempt by other GPL websites to utilize WordPress Premium Themes & Plugins to stock and update their own websites is strictly prohibited and will result in immediate account termination, without entitlement to refunds.
Links
Provider has not reviewed all linked sites and does not assume responsibility for their contents. Inclusion of any link does not imply endorsement by Provider, and use of such linked websites is at the user’s own risk.
Accuracy of Materials
While efforts are made to ensure the accuracy of materials on Provider’s website, technical, typographical, or photographic errors may occur. Provider does not warrant that all materials on its website are accurate, complete, or current, and reserves the right to make changes without notice.
Copyright / Trademark Claims
Provider respects intellectual property rights. To submit a copyright infringement notification to Provider, a written communication must be sent, including the following:
- A physical or electronic signature of an authorized individual acting on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the infringing material and information to enable Provider to locate it.
- Contact information of the complaining party.
- A statement of good faith belief that use of the material is not authorized by the copyright owner.
- A statement that the information in the notification is accurate, and the complaining party is authorized to act on behalf of the copyright owner.
Product Warranty
Provider does not offer any warranties. All goods and services are provided “as is,” without any express or implied warranties. To the extent permitted by law, all warranties are excluded.
Liability For Our Products And Services
Provider, its suppliers, and distributors will not be liable for lost profits, revenues, or data, financial losses, or indirect, special, consequential, exemplary, or punitive damages. Liability for any claim under these terms is limited to the amount paid by the customer for Provider’s goods and/or services. Provider will not be liable for any loss or damage that is not reasonably foreseeable.
Miscellaneous
- Updates to TOS: The Terms of Service may be updated from time to time, with notice provided on this page. Changes become effective no less than fourteen days after posting, except in cases of urgent legal necessity.
- Other Guidelines or Terms: In the event of a conflict between these Terms of Service and those for a specific Provider service, the terms specific to the service will prevail.
- No Third-Party Beneficiaries: These terms govern the relationship between Provider and users and do not confer third-party beneficiary rights.
- No Waiver: Provider’s failure to enforce these terms immediately does not constitute a waiver of any rights.
- Severability: If any term in the Terms of Service is deemed unenforceable, it will not affect the enforceability of other terms.
